Child Custody/Visitation

The standard that Georgia uses to determine child custody is, "What is in your children's best interest."  

Child custody issues can arise during an original divorce action or through a modification of a prior agreement.

Everyone always agrees that the Court needs to make a decision about custody of the child based on what is in the child's best interest. However, the issue that commonly arises in family law cases is that the Parents do not agree on what is in the best interest of the child. There are two types of custody that have to be decided in these cases:  

Child Custody/VisitationLegal Custody:  Legal custody involves the person that is making the decisions about the child's upbringing including but not limited to the child's medical treatment, education and religious affiliations.

Physical Custody:  Physical custody involves who the primarily lives with.

Both aspects of custody must be considered during child custody proceedings.
